That’s one of two questions that I have about “spygate”

I’ve gotten great amusement from the evolution of the spying-on-Trump story …

First, the FBI/CIA denied that that they planted a spy on the Trump campaign … “no way, Trump is crazy”.
Then there were a flurry of stories indicating that a spy was indeed engaged … “but don’t release his name”
Then the positioning: “that would be a good thing” … “done to protect Trump” … from what?
Finally, the name of the spy-who-wasn’t was leaked … some professor with a long history working with the FBI & CIA.
But, he wasn’t a “spy”, he was a “tasked informant”.
OK, that parsing should make everybody feel better, right?
Let’s dig a little deeper…

Comey intended to let Clinton walk before interviewing her or 16 other key witnesses

With all of the attention directed at Charlottesville and Hurricane Harvey, you might have missed this one.
According to the Washington Post and multiple other MSM sources …
The Office of the Special Prosecutor (Mueller) turned over to the Senate Judiciary Committee (Grassley) transcripts of interviews with a couple of Comey’s key lieutenants: James Rybicki, Comey’s chief of staff, and Trisha Anderson, the bureau’s principal deputy general counsel for national security and cyberlaw.
The pair gave corroborating testimony that Comey was planning to exonerate Clinton long before the FBI had completed its investigation.
Specifically, three or four months before Comey’s infamous July 2016 press conference, he drafted and circulated an outline of what he eventually said.
That’s before the FBI interviewed Clinton (a session that Comey didn’t even bother to attend) or 16 other key witnesses – -some of whom were granted immunity for their testimony and allowed to trash their own electronic devices without the FBI taking a peek at them.

There are several curious aspects to this revelation ….

Hillary is dishing why she lost … except the obvious.

She’s on a pre-release tour laying the groundwork for 2 books that come out this fall.
Earlier this summer, she perched on a faux-throne at CodeCon and the Javits Center …spilling the beans on why she lost.

This week she released some self-narrated excerpts from the audio version of the first book “What Happened?”
Of course, there are the usual villains: Comey, the Russians, WikiLeaks, deplorables, etc.
But, she’s also starting to turn on her support base: the DNC (bad data, no money, no ground game), mainstream media (for disclosing that she had classified docs on her server), women (both suburban and rural, urbans were ok), and low-information voters (her base !).
My personal favorite: “content farms in Macedonia” … apparently there’s an army of tech savvy social media writers based in Macedonia who turned their cannons on her.
Really?

Some key points are being overlooked.

Fueled by rumors and “secret intel assessment”, election-deniers are having a field day blaming Queen Hillary’s loss on the Russians and alleging that Trump is in Putin’s back pocket.

Beyond the hypocrisy of the Dems hissy fit over Trump’s refusal (in debate #3) to commit to accepting the election results if they seemed tainted (<= ironic, isn’t it?), the deniers seem to be overlooking a couple of key points.

Yesterday, Acting FBI Director Andrew McCabe testified before a Senate oversight committee.
McCabe was Comey’s second-in-command … previously best known for having a wife who ran for office in Virginia with mucho financial backing from the Democratic party and Gov. Terry McAuliffe – a longstanding Clintonista.
The connection raised obvious questions about conflict of interests during the Clinton email investigation.
Point: he’s certainly not a shill for the GOP.

The mainstream media, led by the NY Times, took to headlining that:
Mr. McCabe rejected the White House’s assertion that Mr. Comey had lost the backing of rank-and-file F.B.I. agents.
“Director Comey enjoyed broad support within the F.B.I. and still does to this day.”
Hmmm.
Let’s dig a little deeper …

Given Comey’s firing and the to-be-expected blow back, let’s flashback to our analysis last July — the day after he gave Hillary her stay-out-of-jail free card.
Saw this one coming …

A weird turn of events put Comey under a particularly bright spotlight.
Before the events of the past week, the way I expected things to work out:
- Comey reads the 1st 14 minutes of his his speech laying out the body of evidence, concluding with a recommendation to indict.
- AG Lynch immediately puts the kabosh on the recommendation, refusing to indict.
- Or, AG Lynch green lights an indictment and President Obama quickly steps in to pardon Hillary “for the good of the country”.
- Hillary continues her campaign to become the first woman president.
Comey would have drawn the correct legal opinion based on the evidence, but the course of history wouldn’t have changed.
But, things didn’t work out that way, and Comey found himself in a much brighter spotlight … and, when the story ends, it won’t be pretty for Comey

Team Clinton worshiped at the altar and got burned.

One of the themes in the book Shattered was that theClinton campaign got fixated on their data-rich electorate models, applying the models robot-like to allocate ad dollars, deploy field workers and schedule “market visits” by Hillary and her surrogates.

What Team Clinton seemed to have forgotten is the old Reagan adage: trust but verify.
The data models – which worked near-flawlessly for Obama – took the stage as “shiny objects” that led the Clinton campaign astray.
Politico reported a case study that illustrated the point …

Well, actually, there’s somebody who is worse..

The Washington Post just reported a poll that is, charitably speaking, unfavorable for President Trump.

According to the Post’s analysis:
Trump has reached the 100-day marker in his presidency faring worse to much worse than other recent presidents.
Specifically: Trump’s approval rating stands at 42%, the lowest recorded at this stage of a presidency dating to Dwight Eisenhower.
In comparison, President Obama’s approval was 69% at this point in his Presidency.
But, to the obvious shock & dismay of the WaPo’s reporters, there doesn’t seem to be much indication of buyer’s remorse.

Well, that’s not totally true.
I was swayed by a WSJ reviewer’s conclusion that:
“Shattered” is not a pleasure to read.
The book is also too long.
It’s 400 pages of Clintonian self-aggrandizement, campaign malpractice and passive-aggressive blame-shifting.
More than any ordinary reader can bear.
Since I modestly fashion myself to be just an “ordinary reader”, I just digested a range of book reviews from the New York Times, NPR and the Wall Street Journal.

Comey probably did cost the Dems the White House …

Here’s something for Dems to ponder on inauguration day.
My theory of the case from the get-go was that
(1) Hillary did break the law by grossly (and intentionally) mishandling classified information
(2) There was both harm & foul … i.e. foreign agents hacked the info.
(3) Comey brushed past the intent (which wasn’t really required for criminality) and the harm of the foul … because he didn’t want to go down in history as the brutish guy who stopped the first woman from being elected president.

Here’s the irony for the Dems ….

Her action might prompt re-opening of the Clinton server investigation.

Departing AG Lynch lobbed a clock-winding-down grenade … unleashing the DOJ’s inspector general to review “broad allegations of misconduct involving FBI Director James B. Comey and how he handled the probe of Hillary Clinton’s email practices.”
Center stage are Comey’s July 5 non-sequiturial press conference (lots of evidence, but issue a stay-out-of-jail free card anyway), his re-opening of the case when classified emails were spotted on Anthony Weiner’s laptop and Comey’s last minute pronouncement for every to fuggitaboutit.

There are a couple of ways that Dem-loyal Lynch’s ploy might backfire.
First, beyond Comey, the IG said that he’ll be investigating “whether Peter Kadzik, the Justice Department’s assistant attorney general for legislative affairs, improperly disclosed non-public information to the Clinton campaign” and whether “FBI Deputy Director Andrew McCabe should have been recused from the case since his wife, Jill McCabe, ran for a Virginia Senate seat and took money from the political action committee of Virginia Gov. Terry McAuliffe, a fierce Clinton ally.”
Said differently, the IG is likely to find more influence peddling and tampering from the Clinton side than from the Trump side.
Second, while Lynch has narrow-scoped the investigation to exclude her not-so-secret tarmac meeting with Bill Clinton, an in-coming AG might broaden the scope to dig into the “event” that forced Lynch to punt the ball to Comey … setting the stage for his press conference and letters.
Her improprieties certainly contributed to the mess.
Third, and most important, while the IG said that he’s not going to relitigate the findings in the Clinton case, the IG review is likely to rip off some scabs at the FBI and prompt a re-look at the case.
And, there are a couple of plausible motivators for re-opening Clinton’s file …

She landslided California, but lost the combined popular vote in the other 49 states (& DC).

Dems are still carping that Trump’s ascendency is illegitimate since Hillary won the popular vote.
And, everybody knows that Hillary won big in California.
But, I was a bit surprised by how big her California win was … and its implications.
Bottom line: Clinton won the national popular vote by 2.8 million votes … buoyed by a 4.3 million edge in California.
Think about that for a second.

Yes, Clinton won California big time … but, Trump won the combined popular vote of the other 49 states (& DC)
The MSM repeatedly observes that Trump followers drag their knuckles … and that Hillary dominated among the intelligensia.
So was Clinton’s success in California simply explained by Californians being smarter than the rest of the country?
Quick quiz: how does the average Californian’s IQ rack up against residents of other states?
The answer may surprise you ….

Back in March 2009, Secretary of State Hillary Clinton presented Russian Foreign Minister Sergey Lavrov with a small green box with a ribbon.
Inside was a red button with the Russian word “peregruzka” printed on it.
Clinton offered that pushing it would “reset our relationship” … ostensibly, for the better.

The most recent Washington Post poll – showing Hillary leading Donald by a couple of points — provides some very interesting drill down data … it’s worth some browsing time.
Buried in the numbers is some interesting data…..

MSM headlines frequently stereotype Trump’s supporters as non-college degreed whites … and often, the label is shorthanded as a more pejorative “uneducated”, i.e. mind-numbed dummies.
According to the WaPo poll, it’s true that Trump is favored by “white non-college” almost 2-to-1 … 60% to 33%

The lingering question is “intent”.

Let’s connect a couple of dots today …
I’ve been wondering why Comey re-opened the email investigation, why it will take awhile to resolve itself, and what the outcome will be.
A couple of occurrences brought things into focus for me.
=======
First, my son and I were chatting about how the Clintons always push to the legal edge of the law (or further), but don’t leave many fingerprints… and certainly no smoking guns.
I opined that they’re like the mob bosses who direct activities with ambiguity and deniability.
You know, like the “it would be too bad if he had an accident” line used to order a hit.
=======
The 2nd occurrence was Obama weighing in on Comey yesterday for being premature in issuing his letter and reprimanding that “it’s not the way we do things around here.”

Hmmm.
How do “we” do things around here?
=======
Got me thinking back to Comey’s July non sequitur ruling: she broke the law … no direct evidence of intent … so, no charges.
Since then, it has become clear that the law in question does not require proof of intent.
To the contrary, it was written so that intent would be immaterial
So, where did Comey get the idea?

Trump is leading by 9 points among Catholics.

A few weeks ago, WikiLeaks posted some emails in which senior Clinton staffers disparaged Catholics,
At the time I wondered if the disses would be a wake-up call to Catholic.
Apparently, the answer is “yes”
Trump has now opened up a sizable lead with Catholics … and with Protestants (which I assume includes Evangelicals)

Quick takes on the FBI re-opening Hillary-gate ….

Irony
Ironic that somebody who BleachBit 33,000 subpoenaed emails is now ranting the virtues of transparency.
Also ironic: a campaign that has centered on an opponent’s sexual indiscretions is rocked by revelations from another sexual indiscretion case involving a Weiner (that isn’t Bill’s).
P.S. Reports are that many of the 10,000+ emails are from the deleted 33,000 … perhaps, in the spirit of transparency, Hillary should release the 33,000 … gotta believe that there’s a stash of them somewhere.

U-turn
After months of praising Comey’s impartiality and courage … Team Hillary now is complaining that he’s a political hack.
I guess that the original Grandma Homa was right: what goes around, comes around.

Conspiracy
Conspiracy from the left: Predictable rants that Comey was just lying in wait to pounce at the right time and help Trump
Score that one far-fetched.
Conspiracy from the right: Chatter that the FBI action is simply to draw attention away from bigger sins, e.g the “Bill Clinton, Inc.) revelations of egregious pay-to-play – shaking down countries & companies for special state department treatment.
Score that one fetched.
Conspiracy from right: AG Lynch trying to squash investigation to protect Hillary.
Score that one certain since multiple sources report it.

The Issue
Finding more classified info doesn’t move the case forward.
So, Comey must think there’s either evidence of intent … or lying to the FBI.
Remember, it was the latter that put Scooter Libby in jail during the the Watergate fiasco.
Update: Huma told FBI that she had turned over all personal devices with the Hillary emails.
Oops.

Likely outcome
Huma will get thrown under the bus (or, jump under the bus) and take the fall for mis-handling classified info … clear proof that she moved classified info to a non-secure system … and proof that she fibbed to the FBI.
That won’t close the investigation … don’t forget that a video emerged of Hillary lecturing State Department personnel that using personal email for State business is a violation of policy and a crime if there’s classified info. No number of “can’t recall” claims neutralize that one. She knew it was a crime and did it anyway. Comey can’t ignore that.
Hillary Clinton will be the first candidate to be elected President while under FBI investigation.
President Obama will pardon her on or about November 9 “for the good of the country”.
Keep in mind that Wiki revealed that Obama emailed Clinton on her private server address … sometimes using a Carlos-Danger-like alias. OK, maybe he didn’t notice the email address, but … using an alias? It’s in the President’s to pardon Hillary and stop the investigation.
When the pardon is issued, about half of the country will agree with Trump that the system is rigged.

One of this week’s WiliLeaks certainly caught my attention:
Clinton’s senior staffers exchanged several emails that mocked the Catholic church, referring to it as a Middle Ages dictatorship”.
Hmmm.
Raises a couple of questions.
First, do they think that this guy a “Middle Ages Dictator”?

Seriously, the most liberal Pontiff in the history of the Catholic Church?
OK, he still preaches that partial births abortions are a no-no … but, on most issues, he has moved the Church towards most planks of the Progressive platform.
I thought they’d love the guy.

Bigger question: if Islamaohobia is bad, how can Catholiphobia be OK?
In fact, no just OK, it’s socially fashionable.
I guess that isn’t really a surprise.
Many authors have referred to Catholicism as “the last acceptable prejudice”.
Not OK to raise your eyebrow at Jihadists who cut off people heads.
But, OK to trash Neanderthals who think that lives are sacred.
Go figure.
Only consolation for Catholics is that Team Clinton says that Evangelicals are even lower on the food chain.
Somehow, that doesn’t make me feel better,
Wonder what the priests will say at masses this Sunday.
My bet: it’ll be swept under the altar’s rug.
We’ll see.

This one has been hiding in plain sight for a long time.
I’d been wondering why this tape has largely gone unnoticed by folks.
Maybe, because it’s damning to Hillary, not Donald?
Well, it’s likely to get noticed now.

In one of his tirades about Clintonian women abuse, Trump landed a body blow:
“One of the women, who is a wonderful woman, at 12 years old, was raped at 12,” Trump said. “Her client she (Clinton) represented got him off, and she’s heard laughing (on tape) on two separate occasions, laughing at the girl who was raped.”

According to the Washington Post …
The attack on Clinton has less to do with the fact that she defended an accused rapist and more to do with how she did it and what she said about the case later
Specifically, it focuses on her efforts to attack the girl’s credibility and allegations that she spoke callously about getting the man a reduced charge, despite appearing to suggest he had been guilty.
The attack plays into twin allegations about Clinton’s character:
1) That she lacks a moral compass and will do whatever is advantageous to her, and
2) That she’s a hypocrite who says one thing today about sexual assault but did the opposite decades ago.

My objection is technical, not political,

The phrase “don’t grade him on a curve” has now eclipsed “It’s not who we are” as my absolute least favorite.
Folks who are saying it (think, Clinton supporters) are inadvertently flaunting their ignorance (which makes for great irony).
Speaking as a card-carrying academic, my objection is strictly technical.

Now, will Trump draw inspiration from Rocky?

The debate reminded me of the classic clip from the first Rocky movie.
In the flick, Apollo Creed –- fighting within the Marquess of Queensberry Rules — was pummeling Rocky … round after round after round.
With little time left in the fight, Rocky uttered those memorable words:
“I ain’t going down no more”
Then, he came out of his corner like a bull and changed the trajectory of the fight.

My view:
Clinton pummeled Trump, but she didn’t knock him out.
Trump landed a few strong punches.
Trump lives to fight another a day.
He’s a fighter.
Let’s see if Trump pulls a Rocky.

Holt nibbled at Trump all night, but gave Trump the most important gift: making the first 15 minutes about the economy.
Takeaway from that segment – which pundits pre-argued would be determining – was that Trump will be aggressive on saving jobs and Clinton will create tax payer funded green energy jobs.
Advantage: Trump.
Clinton’s biggest score (with a boost from Holt): birther issue “proves” that Trump is a racist.
Trump’s biggest scores: “why haven’t you done any of this in the past 30 years?” and firmly headlined “law & order”.
Both demonstrated why they’re the most disliked candidates ever.
OK, now for the numbers which, frankly, surprised me ….

Bottom line: Pundits will dismiss the internet polls and score it heavily for Hillary … but Donald gets to crow about the overnite results and lives to fight another day.
My question: what ammo does Hillary have left for the next debate?

In a prior post — In Google we trust? – we recapped some experiments that seemed to suggest that Google was rigging its search engine to favor Hillary Clinton.
Now, there’s more evidence …
Robert Epstein – “a distinguished research psychologist” – and his associates at the American Institute for Behavioral Research and Technology (AIBRT) — a nonprofit, nonpartisan organization based in the San Diego area — have been investigating claims that Google systematically alters search results to favor Hillary Clinton.

By now, you should have heard that – during her FBI interview – Hillary had trouble recalling many details.
Details such as whether she gave or got state department guidance on email policy.
More of the “I can’t recall” items are listed at the end of this post
For the record, she signed a statement stating that she understood the rules & consequences … and emailed her minions about the importance of following the policy to the letter.
Easily forgotten, right?
And, she told the FBI that she could not recall any briefing after her December 2012 fall that left her with a concussion.
Say, what?
That’s presidential timber for you …

Frankly, I expected Hillary to plead the ‘George Castanza Defense’ … just asking “was that wrong?”
Nope she went the Steve Martin route.
In a famous skit, Martin tips people how to get a million dollars tax-free.
His advice:
First, get a million dollars and don’t pay taxes.
Then, when the IRS calls, tell them “I forgot … I forgot to pay taxes.”
Martin offers the same advice for bank robbery and other transgressions.

Predictably, the Times slams Trump for a refusal to wade through policy books or practice mock debates.
Hillary, though, is disciplined, studious and advice-seeking.
She’s consulting with psychologists “preparing ways for her to unnerve Mr. Trump and provoke him to rant and rave.”
They conclude that Trump’s hot buttons are: his intellect, his net worth and his image as a successful businessman.
Easy picking, right?

Report insinuates that Google gives biased search results.
Here are some surprising results and a bit of tech advice for you.

Let’s start with a very retro piece of tech advice.
Long ago, a techie friend of mine advised: “Always over-specify your searches”.
English translation: When searching, use more words rather than fewer to make your search more specific and, thus, make the likely answers be most relevant.
If you get no or too few hits, re-search by making the search less specific, i.e. take out some of your qualifying words.
Works for me

Bottom line: Neither ignorance nor innocent intent are stay-out-of-jail cards for ordinary folks.

Let’s connect two articles from last week.
The first is a legal opinion from The Hill:

It’s relatively short and direct – well worth reading.
The essence of the legally supported conclusion:
In letting Hillary off-the-hook, Comey revived two old, tenuous legal defenses: “ignorance of the law” and “no direct evidence of criminal intent”.
Every kid is taught that ignorance of the law isn’t an excuse, right?
And, courts have regularly dismissed the need for prosecutors to prove “willfulness”.
If you did it, you did it
Old adage: Do the crime, do the time (or pay the fine).
But, since Comey’s leniency rested on ignorance and willfulness (“no direct evidence of criminal intent”), those defenses are making a comeback.

Watching the Olympics last night, I was sneak-exposed to a Hillary jobs ad.
The 3 point plan: (1) make everybody pay a fair share – where, of course, ‘everybody’ is shorthand for ‘somebody who is not you, so cheer’ (2) ‘invest’ in infrastructure – where ‘invest’ means overspend on poorly managed government projects using Cadillac-planned union workers and (3) institute an “exit tax” to keep companies from leaving the U.S.

It was the exit tax that caught my eye … partially due to the ads placement in the Olympics and because Trump gave his economic speech a few hours earlier.

Over the weekend, former President Bill (Bubba) Clinton lashed out at FBI Director James Comey.
You may remember that Comey laid out the evidence against Hillary … and then let her walk.
Righties were displeased because of Comey’s illogic: The conclusion didn’t follow from the premises.
Lefties simply dispute premises … since they reveal Hillary to be a boldface liar.
Hubby summed it up: “Comey is full of bull …)
Hmmm.
Former President calling out the current FBI Director … who gave his wife a stay-out-of-jail free card.
My question: will Comey take that lying down?

It’s no secret that only about half of the U.S. Voting Age Population (VAP) turns out to vote … and that the vast the majority of Americans are poorly (or narrowly) informed on political issues.
These days, pollsters are saying that a high percentage of Americans have a high level of interest in the 2016 Presidential race.
I got into a friendly debate re: whether “interest” is a valid proxy measure for “informed”.
My POV: nope.
For example, how many people were interested enough to watch the Trump & Clinton acceptance speeches at their conventions?

Brutal op piece by Peggy Nooman in the WSJ last Friday.
The title tells most of the story: “The Week They Decided Donald Trump Was Crazy”.
The evidence: his taking the Khan bait and dissing Ryan and McCain.
“People started to become convinced he was nuts, a total flake.”

That’s all that most folks will take from the article.
But, there was an important twist that most folks will miss or dismiss.

Headline in Drudge: “Grandma helped up stairs.”
In this 2016 picture, a frail –looking Hillary Clinton – who has a history of injuries from falls (including at least one concussion) – hobbles up a flight of stairs with the assistance of Secret Service agents and aids.

Poignant imagery, right?
The mainstream media will likely bury the picture.
But, I fully expect Trump to ask:
“Is she even physically able to handle the Presidency?”

OK, let’s start with the obvious: Trump had a very, very bad week … and, if I were Trump, I’d rather have Clinton’s poll results than Trump’s.
But, Trump’s campaign obit may be a bit premature.
At least one poll’s results suggest that Donald may still have a pulse.
The Reuters / IPSO poll shows a typical dissipation of Hillary’s post-convention bounce … and a statistically significant bounceback for the Donald … narrowing Clinton’s advantage to only 2.4 percentage points … within the margin of error.

Clintonites surely consider the results to be simply an outlier.
For Trumpsters, it’s a ray of hope.
Which is it?

According to pollster Frank Luntz …
“It’s not the low-information “undecideds” who will determine the election, it’s the “none-of-the-above voter” … who knows lot about both candidates and doesn’t like either one.”
These folks have deeply held opinions about what they want and expect from the next President.
“They can’t stomach the choice between “crude” and “corrupt” … a decision with no good outcome.”

Luntz concludes that these none-of-the-above voters have eight core hot buttons …
